⁣Magistrate Rob Stary has thrown out the criminal case against a police officer that knocked a man unconscious in Melbourne during a protest in 2021.

The Magistrate claims no jury would be able to come to a conclusion as to whether the actions were unlawful.

“It may be that the arrest was executed in a way that is not in strict accordance with the manual, but whether it could be said to be unlawful and whether it could be said to be done without any regard to the probable consequences and criminal intent, in my view a jury properly instructed could not convict Mr Barrett of those offences.”

Would the same measure of judgement be used if a member of the public behaved in this manner?
